1. Acceptance of Terms

By placing an order with Elevator Signs NYC or any affiliated company, you (the “Customer”) agree to be bound by these Terms of Sale and Legal Disclaimer. These terms govern all purchases, returns, and usage of products purchased from Elevator Signs NYC.

2. Responsibility for Code Compliance

It is solely the Customer’s responsibility to ensure that all signage products are selected, installed, and maintained in compliance with all applicable federal, state, and local laws, including but not limited to:

  • NYC Department of Buildings (DOB)

  • NYC Housing Preservation and Development (HPD)

  • NYC Fire Department (FDNY)

  • Americans with Disabilities Act (ADA)

  • International Building Code (IBC), and

  • Any other regulatory agency or authority having jurisdiction

Elevator Signs NYC does not provide legal or architectural advice and makes no guarantee that our signs meet specific code requirements for a particular location or project. Customers must verify compliance before placing an order.

3. Product Warranty and Use Disclaimer

All products are provided “as is” and “as available,” without warranties of any kind—express or implied—including merchantability, fitness for a particular purpose, or durability.

Elevator Signs NYC disclaims any liability for misuse, incorrect installation, modification, or interpretation of signage.

Customers are responsible for proper installation and ensuring placement meets current code and inspection requirements.

4. Limitation of Liability

To the fullest extent permitted by law, the total liability of Elevator Signs NYC and its affiliates shall be strictly limited to one U.S. dollar ($1.00) per order or transaction.

We shall not be liable for any direct, indirect, incidental, consequential, punitive, or special damages related to the use of our signs, including but not limited to:

  • Inspection failures

  • Code violations

  • Tenant complaints

  • Delays or penalties from agencies

By purchasing, the Customer waives the right to pursue any claim beyond $1.00.

5. Indemnification

Customer agrees to indemnify, defend, and hold harmless Elevator Signs NYC, its owners, employees, agents, and affiliates from any claims, fines, legal actions, or damages arising from:

  • Improper use or placement

  • Regulatory non-compliance

  • Third-party disputes (tenants, landlords, inspectors, etc.)

  • Misinterpretation of signage requirements

6. Returns and Exchanges

  • Standard products may be returned or exchanged within 30 days of purchase, pending prior written authorization.

  • Custom or made-to-order signs cannot be returned unless they are damaged or defective upon arrival.

  • Items must be returned in new, resalable condition.

  • Return shipping is the Customer’s responsibility unless the item was defective.

7. Shipping and Fulfillment

All orders ship from Brooklyn, NY. We strive to ship standard in-stock items within 1–2 business days.

Custom signs or large orders may require additional time. Rush orders or pick-up requests should be coordinated in advance.

8. Sales Tax

Sales tax will be applied to orders shipped within New York State unless a valid resale or nonprofit exemption certificate is submitted with the order.

9. Order Changes or Cancellations

Orders may be canceled prior to shipping for a full refund. Once shipped, the return policy applies. All order cancellations must be confirmed by email or phone. see Shipping & Returns

10. Business Representation Disclaimer

Elevator Signs NYC is a small, family-owned and operated business located in Brooklyn, New York. We are not affiliated with or endorsed by the City of New York or any federal, state, or local agency, including:

  • NYC Department of Buildings (DOB)

  • FDNY, DOT, DSNY, or any other NYC department

11. Privacy and Security

All payment data submitted through our site is encrypted and processed through secure, PCI-compliant systems. We do not sell or share personal information.

12. Additional Legal Protections and Limitations

a. No Guarantee of Inspection or Approval

Elevator Signs NYC does not guarantee that any product will pass inspection or be approved by any authority. Approval depends on how the signage is used, where it is placed, and whether local conditions meet code. Any failure to pass inspection is the sole responsibility of the purchaser.

b. Force Majeure Clause

Elevator Signs NYC shall not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including but not limited to:

  • Natural disasters (flood, fire, hurricane)

  • Supply chain disruptions

  • Transportation delays

  • Labor shortages or strikes

  • Acts of God, terrorism, war, or government action

c. Disclaimer of Professional Advice

No employee or representative of Elevator Signs NYC is licensed as a professional engineer, architect, code consultant, or attorney. Any guidance, examples, or information given verbally, in writing, or via the website is informational only and not a substitute for professional advice. Customers must consult a qualified expert before relying on any interpretation of code or signage requirement.

d. Customer Assumes Risk of Use

By purchasing and installing any signage, the Customer assumes all risks associated with the use, installation, and interpretation of that sign. This includes, but is not limited to:

  • Misinterpretation by inspectors

  • Use in unauthorized areas

  • Modifications made to the signage

  • Damage or wear over time

  • Placement in hazardous or inappropriate locations

Elevator Signs NYC is not liable for any bodily injury, property damage, fire hazard, or tenant complaint arising from sign placement or use.

e. Photography and Representation Disclaimer

Images, dimensions, and finishes shown on our website are for reference only and may vary slightly due to manufacturing processes, lighting, screen settings, or material sourcing. Exact color, font thickness, or finish is not guaranteed to match a digital photo preview.

f. No Third-Party Beneficiaries

These Terms & Conditions are between Elevator Signs NYC and the direct purchaser. No third party, including building inspectors, tenants, landlords, or governmental agencies, shall have any rights to enforce these terms or hold Elevator Signs NYC liable for claims.
